1. Acceptance of Terms

By accessing or using FOMO Menu (the "App"), you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. You are responsible for all content you generate or submit through the App.

• You must be at least 13 years old to use the App. If you are under 18, you must have your parent or legal guardian's permission.
• You agree not to use the App to generate content that is illegal, harmful, defamatory, obscene, infringing, or otherwise objectionable.
• We reserve the right to terminate or suspend your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the App, us, or third parties, or for any other reason.

3. AI Generated Content

The App utilizes artificial intelligence to generate menu content. While we strive for accuracy and quality, we make no warranties or representations regarding the output of the AI. You are solely responsible for reviewing, editing, and verifying any AI-generated content before use.

You retain ownership of the specific inputs you provide to the AI. You acknowledge that AI-generated content may be similar or identical to content generated for other users. We do not claim ownership over the AI-generated content that is specific to your inputs, but you grant us a license to use it for the purpose of providing and improving the App.

4. User Accounts and Subscription

• You are responsible for maintaining the confidentiality of your account and password.
• Subscription fees, if applicable, are set forth on our pricing page and are subject to change. All payments are processed through Stripe, and you agree to Stripe's terms and conditions.
• Free tier limitations (e.g., number of menu generations) are subject to change.

5. Intellectual Property

The App and its original content (excluding AI-generated content based on your inputs), features, and functionality are and will remain the exclusive property of FOMO Menu and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall FOMO Menu, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

7. Disclaimer

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction - e.g., State of California, United States], without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
